Nominations Now Open for the 2023 Human Rights Award

The following is being distributed at the request of the Human Rights Commission of Newfoundland and Labrador:

Nominations are now open for the 2023 Newfoundland and Labrador Human Rights Award. This award recognizes an individual who has made and/or continues to make a meaningful contribution to advancing and furthering human rights in the province.

The deadline for nominations is October 2, 2023. The award will be presented on Thursday, December 7, 2023, at the Government House in St. John’s in celebration of International Human Rights Day. The award ceremony will have both in-person and virtual attendance available. Follow us on Twitter and Instagram @nlhumanrights for updates on the ceremony.

You can submit a nomination form online at www.thinkhumanrights.ca. However, if you have questions about the nomination process or would like to complete the nomination form in an alternative format, such as an interview, please contact the Newfoundland and Labrador Human Rights Commission.

Public Advisory: T’Railway Provincial Park Closed Between Doyles Road and Cemetery Road in Conception Bay South

The public is advised that the T’Railway Provincial Park is closed until further notice from Doyles Road to Cemetery Road in Conception Bay South.

The Town of Conception Bay South, in partnership with the Grand Concourse Authority, are upgrading the trail in that area.

The public is asked to report any damage or concerns related to the T’Railway to the Parks Division of the Department of Tourism, Culture, Arts and Recreation by emailing trailway@gov.nl.ca or by calling 709-637-2040.

Minister Parsons to Participate in Offshore Europe Conference

The Honourable Andrew Parsons, KC, Minister of Industry, Energy and Technology, will be in Aberdeen, Scotland this week for the Offshore Europe Conference and Exhibition 2023.

Minister Parsons and a delegation from Newfoundland and Labrador will join Energy NL as it leads a joint Atlantic Canada Pavilion at the conference, which runs from September 5 to 8, 2023. Energy NL is taking the lead on the pavilion, which was previously managed by the Maritimes Energy Association. Newfoundland and Labrador’s delegation includes more than 35 people, representing more than 10 companies. Representatives from Newfoundland Labrador have been attending this event since the early 1990s.

This year’s Offshore Europe theme is “Accelerating the transition to a better energy future”. Much of the focus at this year’s conference will be on the transition towards net zero, with a focus on carbon capture technologies, as well as producing, transporting, storing and using low-carbon hydrogen. The 2023 event, which marks the 50th anniversary of the first Offshore Europe conference, has four key pillars: energy security, energy transition, future talent and innovative technology.

The Department of Industry, Energy and Technology will partner with the Atlantic Canada Opportunities Agency and the Government of Nova Scotia at the Atlantic Canada Pavilion. More than 38,000 people took part in Offshore Europe’s last pre-COVID-19 gathering in 2019. This will be the first full-scale gathering since that time. Offshore Europe runs concurrently with a technical conference held by the Society of Petroleum Engineers.

Offshore Europe attracts the leading service and technology companies as well as operators promoting solutions to optimize exploration and production. The conference is an opportunity to promote the energy and supply and service sectors in Newfoundland and Labrador.

Travelling Orthopaedics Program Expansion to Increase Access to Surgeries

A travelling orthopaedics program is expanding to Carbonear General Hospital to complete orthopaedic surgeries in the region starting September 25, 2023.

The Honourable Dr. Andrew Furey, Premier of Newfoundland and Labrador, made the announcement today in Carbonear with the Honourable Tom Osborne, Minister of Health and Community Services, and Dr. Will Moores, Divisional Head of Orthopaedics, NL Health Services.

This builds on the work the travelling team of surgeons has been doing during visits to St. Anthony, which has resulted in patients receiving orthopedic surgery sooner than expected.

The program in St. Anthony has the potential to accommodate approximately 140 surgeries annually. By expanding the program to Carbonear, the Department of Health and Community Services anticipates at least 150 surgeries can be performed each year – this means a total impact of at least 290 additional orthopaedic surgeries completed annually.

Between January and July of this year, 76 surgeries were performed by the team of surgeons travelling to St. Anthony.  The patients who received surgery would otherwise have to wait to get their surgery in St. John’s which can take more time given the high demand from the more concentrated population in the area.

The expansion to Carbonear is one of numerous steps, such as same day hip and knee replacement surgeries in the Northeast Avalon region, that the Provincial Government is taking to help ease the pressures of surgical backlogs in Newfoundland and Labrador.

The Department of Health and Community Services has recently announced it will implement all 32 recommendations of the Provincial Surgical Task Force, including:

  • Developing a centralized list of operating rooms across the province to match surgical availability with facility underutilization;
  • Developing a centralized surgical waitlist, encompassing all regions of the province, to optimize use of all facilities, starting with orthopedics; and
  • Increasing transportation options for patients who are otherwise ready for discharge.

Task force recommendations such as allowing short stays in personal care homes to increase bed capacity in acute care facilities have already been implemented.

The Information and Privacy Commissioner, Michael Harvey, has released his Report P-2023-002 under authority of the Access to Information and Protection of Privacy Act, 2015. A summary of the Report is included below.

Report: P-2023-002 Report Date: August 31, 2023 Public Body: Royal Newfoundland Constabulary Summary: Two Complainants alleged that an employee of the Royal Newfoundland Constabulary (RNC) had improperly accessed their personal information. An internal audit confirmed that two RNC employees had accessed the two Complainants’ personal information and that the access was contrary to RNC policy and operational purposes. The RNC took disciplinary measures against the two employees, which were upheld at arbitration. In response to complaints, our Office undertook a privacy investigation. A prosecution was commenced under section 115 of ATIPPA, 2015 resulting in a guilty plea by one employee and the acquittal of the other. The Commissioner recommended that the RNC continue efforts to improve its culture of privacy, expand training, and implement upgrades to its system to assist with auditing and monitoring access.

Government of Newfoundland and Labrador to Create All-Party Committee on Substance Use and Addictions

The Provincial Government has announced that an All-Party Committee on Substance Use and Addictions will be created in response to the continued need for prevention, early intervention, treatment and support for those living with mental health, substance use and addiction issues, with an emphasis on youth and young adults. The committee will also closely look at the interrelationship between these issues and other social determinants of health, such as housing, poverty and education.

The Honourable Tom Osborne, Minister of Health and Community Services, will be available to discuss the creation of the All-Party Committee at Confederation Building, East Block Lobby, today at 1:00 p.m. Minister Osborne will be joined by Jeff Bourne, Executive Director at U-Turn Addiction Drop-In Centre and Gerard Yetman, Executive Director, AIDS Committee of Newfoundland and Labrador.

Building on the work of Towards Recovery, released by the All-Party Committee on Mental Health and Addictions, and the ongoing implementation of recommendations arising from Health Accord NL, this All-Party Committee will review mental health, substance use and addiction services within the provincial mental health care system. The committee’s goal is to provide recommendations on improvements to existing programs and services, and the development and implementation of new ones where necessary, to better serve the needs of Newfoundlanders and Labradorians into the future.

Appointment of Acting Clerk of the House of Assembly

The Honourable Derek Bennett, Speaker of the House of Assembly, announces the appointment of Kim Hawley George, K.C., as the Clerk of the House of Assembly (acting) effective today, in accordance with subsection 7(3) of the House of Assembly Accountability, Integrity and Administration Act.

Ms. Hawley George served in the position of Law Clerk and Parliamentary Counsel of the House of Assembly since 2017. Prior to joining the Legislature, she served as Chief Legislative Counsel and Assistant Deputy Minister for Legal Services and the Office of the Legislative Counsel in the Department of Justice and Public Safety. Ms. Hawley George is the past president of the Association of Legislative Counsel in Canada and is current president of the Association of Parliamentary Counsel in Canada.

The position of Clerk of the House of Assembly is vacant following the retirement of Sandra Barnes, who served in the position since July 2012.

UNDERTAKINGS REGISTERED:

Canning’s Lake Bee Farm and Forage Area                                      (Reg. 2266)
Proponent: Tuck’s Bee Better Farm Inc.
The Proponent is proposing to establish a bee farm at Canning’s Lake, located along the Bay D’ Espoir Highway in central Newfoundland. The farm would consist of two parcels of Crown land, and development would include the installation of beehives on one parcel and fencing the bee yard. Access to the bee yard would be via Haynes Lake Access Road, an existing forestry access road. The second parcel of Crown land would surround the bee yard and provide a 2042-hectare forage area for the bees. No new road construction or other land use is proposed for the forage area. Gander to Gambo Transmission Line 146L Rebuild                        (Reg. 2265)
Proponent: Newfoundland Power Inc.
The Proponent is proposing to rebuild their 146L transmission line which extends 40.7 kilometres between the Towns of Gander and Gambo in central Newfoundland. The proposed work would include reconstruction of the transmission line where continued maintenance is no longer feasible, as well as brush clearing, the installation of poles and supporting infrastructure, and the dismantling and disposal of decommissioned materials. Northwest River Bridge Replacements                                               (Reg. 2264)
Proponent: Scouts Canada (NL) Properties Inc.
The Proponent is proposing to replace two deteriorating bridges over tributary brooks to Northwest River, a scheduled salmon river. This work is required to maintain access to Camp Nor’Wes, a Scouts Canada (NL) campsite which borders Northwest Pond, near the Town of Port Blandford, in Eastern Newfoundland. Public Advisory: Employers Encouraged to Take Part in Free Global Virtual Employment Fairs Launching September 20

Newfoundland and Labrador employers with an interest in filling their staffing needs with workers from outside of Canada are encouraged to register for upcoming virtual immigration fairs starting in September.

Hosted by the Department of Immigration, Population Growth and Skills, these free virtual fairs will be held between September 20, 2023 and March 27, 2024, starting with East and South East Asia and Oceania regions.

For a full schedule of upcoming virtual employment fairs, please see the backgrounder below.

Interested employers are encouraged to participate in an online information session on Wednesday, September 6 at 10:30 a.m. NDT. Interested employers can also send questions to attraction@gov.nl.ca.

Virtual fairs offer employers the ability to access an international talent pool to fill vacancies that cannot be filled locally. Employers may instantly connect with prospective international candidates, review resumes and schedule interviews. The fairs will focus on certain in-demand sectors in Newfoundland and Labrador, including health care, early childhood education, technology, hospitality and more.

Report: A-2023-038 Report Date: August 29, 2023 Public Body: Department of Forestry, Fisheries and Agriculture Summary: The Complainant requested information from the Department of Fisheries, Forestry and Agriculture (FFA) related to a parcel of Crown Land. The search conducted by FFA did produce the responsive records sought, though with one paragraph redacted under a claim of section 29(1)(a) of ATIPPA, 2015. There was also one responsive record that contained information on additional responsive records that were not provided by FFA. To meet its section 13 duty to assist, FFA performed a second search for documents named in the responsive records but not disclosed and this search produced no further records. The second search for records conducted by FFA was reasonable and the Department provided a detailed reason as to why these other documents could not be found. With respect to FFA’s claim of section 29(1)(a), a review by this Office concluded that this exception was appropriately applied.

Provincial Government Highlights Ratified Collective Agreement with Royal Newfoundland Constabulary Association

 The Government of Newfoundland and Labrador is announcing that a collective agreement has been ratified with the Royal Newfoundland Constabulary Association. This agreement represents approximately 400 members throughout the province.

The Provincial Government and the Royal Newfoundland Constabulary Association worked together to reach a fair and responsible agreement that is intended to strengthen Newfoundland and Labrador’s provincial police service.

Highlights of this agreement include:

  • A six-year collective agreement (2020-2026) with annual salary increases based on the existing compensation formula, which analyses comparable sized police forces across the country;
  • A one-time employee recognition bonus payment of $2,000;
  • Flexibility for employees to substitute a statutory holiday such that they may observe a non-Christian faith based holiday;
  • Improvements to recruit and retain police officers;
  • An increase in maternity, adoption and parental leave without pay to seventy-eight weeks; and
  • The addition of paid family violence leave, providing the ability for employees to take time away from the workplace.

Minister Parsons Announces Companies Advancing in Wind-Hydrogen Process

The Honourable Andrew Parsons, KC, Minister of Industry, Energy and Technology, today announced the completion of the call for bids for wind-hydrogen development in the province. As a result of this process, four companies will receive Wind Application Recommendation Letters:

  • EverWind NL Company;
  • Exploits Valley Renewable Energy Corporation;
  • Toqlukuti’k Wind and Hydrogen Ltd. (ABO); and
  • World Energy GH2 Inc.

The issuance of recommendation letters to four bidders is the next step in the development of a wind-hydrogen industry in the province. These four companies now have the right to pursue the development of their project and can proceed through the Government of Newfoundland and Labrador’s Crown land application and approval process.

The construction, operations and decommissioning phases of these four projects (ranging from 35 to 40 years) are anticipated to have an overall economic impact (GDP) of $206.2 billion, and revenue to the province of $11.7 billion. Based on the plans for the four projects, peak employment is estimated at 11,694 full-time equivalents during construction. Total capital spend is estimated at $66.3 billion.

Projects will be required to have benefits plans with the province, including commitments to full and fair opportunity as well as a gender equity and diversity plan that outlines proactive measures for the inclusion of women and other under-represented groups.

Bids were subject to a two-phase assessment conducted by an evaluation committee, with representation from Industry, Energy and Technology; Finance; Indigenous Affairs and Reconciliation; Newfoundland and Labrador Hydro; a third-party Financial and Business Analyst (EY); a third party Technical Advisor (Power Advisory); a third party Project Management Analyst (EY); and a Fairness Advisor (Optimus SBR Inc.).

Environmental Assessment registration is required prior to final award of Crown land and an environmental assessment will be required for these wind projects.

Requests for connection to the provincial electricity grid to support hydrogen production and/or rates other than published rates will be subject to the PUB regulation.

The Provincial Government is committed to continuing to work with the companies that were not successful in this round and they will have opportunities in the future to apply, either through private lands or future calls for bids.

Wind-Hydrogen Development Timeline

On December 16, 2021, the Provincial Government launched a Renewable Energy Plan, titled ‘Maximizing Our Renewable Future.’ The plan was developed with input from the public, Indigenous Governments and Organizations, industry and stakeholders.

On April 5, 2022, the Provincial Government lifted a 15-year moratorium on onshore wind farms, creating an opportunity for industrial customers to generate wind energy for their own consumption and wind generation export.

On July 26, 2022, the Provincial Government announced that as part of the multi-stage process, and in order to ensure a fair and transparent process for all interested parties, the Department of Industry, Energy and Technology would launch a call for the submission of Nominations of Areas of Interests for wind energy projects in the province. The call was open to any available Crown lands within the province. Nominations began on July 26, 2022 and closed on October 1, 2022.

On October 3, 2022, the Provincial Government announced that 31 land nomination submissions were received for wind energy projects. The Provincial Government began a detailed assessment to determine which land packages would be made available for the first round of the competitive land bid process.

On December 14, 2022, the Provincial Government announced the launch of a Crown land call for bids for wind energy projects. Bids were accepted until midnight on March 3, 2023. A Phase 1 review would be conducted on all bids on criteria such as ensuring the companies have experience, financing, etc. Those companies passing Phase 1 review would proceed to the next phase beginning early April 2023.

On February 23, 2023, the Provincial Government released a new wind-hydrogen fiscal framework for Newfoundland and Labrador. The fiscal framework will be applicable to wind-hydrogen projects in the province and will ensure that the Provincial Government receives benefits for the use of its resources from wind-hydrogen projects. The fiscal framework includes a Crown land reserve fee of 3.5 per cent annually of the market value of the reserved Crown Lands.

On March 24, 2023, the Provincial Government provided an update on bids received from its call for bids for Crown land for wind-hydrogen development. The department received bids from 19 companies. A Stage One review would be conducted on complete bids on criteria such as the bidder’s experience, the project, and their financial capacity to plan, construct, and operate the proposed project. Those companies passing Stage One review would proceed to the next phase beginning May 2023.

On July 6, 2023, the Provincial Government provided an update on the completion of stage one of the crown land call for bids for wind-hydrogen development in the province. Following a Stage One review, including criteria such as the bidder’s experience and their financial capacity to plan, construct, and operate the proposed project, nine bids from nine companies were approved to proceed to Stage Two.

The Stage Two review included a deeper examination of the bidder’s experience, the proposed project, and the project financing plan, as well as an examination of additional information on the electricity grid connection requirements, community and Indigenous engagement, and benefits to the province.

Following the completion of the Land Bid process, four companies are receiving Wind Application Recommendation Letters:

  • EverWind NL Company
  • Exploits Valley Renewable Energy Corporation
  • Toqlukuti’k Wind and Hydrogen Ltd. (ABO)
  • World Energy GH2 Inc.

EverWind NL Company (EverWind) is proposing a multi-phase wind energy project to produce and export hydrogen/ammonia from facilities on the Burin Peninsula.

Exploits Valley Renewable Energy Corporation (EVREC) is proposing a multi-phase wind energy project in central Newfoundland and a hydrogen/ammonia production facility in Botwood to produce and export green hydrogen/ammonia.

Toqlukuti’k Wind and Hydrogen Ltd. (ABO) is proposing a three-phase wind energy project in the Isthmus region to produce and export hydrogen/ammonia with Braya Renewable Fuels through the joint development of green hydrogen production at the Come-By-Chance refinery.

World Energy GH2 Inc. (WEGH2) is proposing a three-phase wind energy project on the province’s west coast and a hydrogen/ammonia production facility in the Town of Stephenville to produce and export green hydrogen/ammonia.

Public Advisory: Update on Repairs to T’Railway Provincial Park Between Heatherton and Port aux Basques

The public is advised that the T’Railway Provincial Park has reopened between Heatherton and MacDougall’s, following repairs to areas that were damaged by heavy rain earlier this summer.

The T’Railway remains closed from MacDougall’s to Port aux Basques while work continues in that area.

The public is asked to report any damage or concerns related to the T’Railway to the Parks Division by emailing trailway@gov.nl.ca or by calling 709-637-2040.

Public Advisory: Temporary Closure of Lanes on Pitts Memorial Drive

The westbound lanes of Pitts Memorial Drive, from New Gower Street to Kilbride, will be closed this evening (Monday, August 28) from 7:00 p.m. to 9:00 p.m.

The closure is necessary to facilitate the jacking of a beam for repair work.

Motorists are asked to pay attention to traffic control and take an alternate route.

Provincial Government Covering the Cost of Drivers Medicals for Seniors

The Provincial Government is now covering the cost for drivers’ medicals for seniors 75 years of age or older in Newfoundland and Labrador. Effective immediately, physicians will now bill MCP directly for this service instead of charging patients.

Coverage for age-related driver medical examinations is retroactive to April 1, 2023. Seniors who have been charged for this service will be reimbursed up to the $100 amount of the fee code established by government and the Newfoundland and Labrador Medical Association.

To be eligible for reimbursement, seniors must provide a receipt indicating that an age-related Driver’s Medical Examination was provided and paid for on or after April 1, 2023.  Examinations not related to age, as well as all examinations prior to April 1, 2023, are not covered.

Seniors may complete the reimbursement form and mail it with the receipt from the physician to:
