Ministerial Statement – Minister Howell Recognizes World Town Planning Day 2022

The following statement was read in the House of Assembly today by the Honourable Krista Lynn Howell, Minister of Municipal and Provincial Affairs:

Speaker, I rise today to recognize World Town Planning Day, celebrated on November 8 each year to mark the contributions of planners to their communities and commemorate the important role planning plays in the creation and development of our towns.

Town planning is one of the most important elements of building organized, livable communities. The work of planners is critical in creating areas where everyone can feel welcome, whether that be in housing, recreation, or simply pride of place.

We were very pleased to have our province represented at the Atlantic Planners Institute 2022 Conference last month in Charlottetown, PEI. It was an excellent opportunity to share knowledge and information with planners across Atlantic Canada.

Speaker, I remind municipalities throughout the province that planners are an excellent resource, and are there to provide guidance on the land use planning process. Such professional resources are important, especially in light of the growing need for municipal leaders to consider ways to mitigate the impacts of climate change in planning for the future development of their communities.

I ask all Honourable members to join me in recognizing World Town Planning Day 2022.

Public Advisory: Government Receives a Report on the Public Interest Disclosures Regarding the Citizens’ Representative

The Honourable Andrew Furey, Premier of Newfoundland and Labrador, advises that the Speaker of the House of Assembly referred a Report on the Public Interest Disclosures Regarding the Citizens’ Representative to the Office of the Executive Council yesterday (November 7).

This report was initiated pursuant to a public interest disclosure filed with the Speaker of the House of Assembly against the Citizens’ Representative respecting an allegation of gross mismanagement regarding the confidentiality and disclosure of information.

This report has also been referred to the House Management Commission, which consists of members representing all parties in the House of Assembly, for consideration and recommendations, if required.

Statutory offices operate independently from government. Given the need to operate independently from the Provincial Government they report to the House of Assembly and include the Chief Electoral Officer, Commissioner for Legislative Standards, the Citizens’ Representative, Seniors’ Advocate, Child and Youth Advocate, the Information and Privacy Commissioner and the Auditor General.

The Governments of Canada and Newfoundland and Labrador Invest in a Pre-Feasibility Study for a Road into Northern Labrador

Today, the Minister of Transport, the Honourable Omar Alghabra, and the Honourable Elvis Loveless, Minister of Transportation and Infrastructure, each announced an investment of up to $200,000 for a total of $400,000 for a pre-feasibility study for the construction of a road connecting the existing Trans-Labrador Highway to communities in northern Labrador, under the National Trade Corridors Fund.

The roadway would connect communities, facilitate travel, reduce travel and shipping costs, increase food security, facilitate access to essential goods and services and create economic development opportunities.

A road into northern Labrador would be expected to start in the vicinity of the Town of Happy Valley-Goose Bay or the Lake Melville area and extend as far north as the Inuit communities of Rigolet, Postville, Makkovik, Hopedale, and Nain, and the Innu community of Natuashish.

The knowledge gained from the research funded by this investment is expected to have important economic and environmental benefits for the region.

The National Trade Corridors Fund provides funding for projects, such as research, in the Arctic and the North to support northern transportation infrastructure like ports, airports, all-season roads, and bridges. These projects enhance the safety, security, economic, and social development in the northern area of Labrador containing the Nunatsiavut region, Canada’s three territories, the Nunavik region in Quebec, and the Town and Port of Churchill in Manitoba.

‘The 18’, a Come Home Year Concert of Remembrance, Free to the Public on November 11

A powerful new musical event entitled ‘The 18’ will take place at the Basilica of St. John the Baptist on Remembrance Day (Friday, November 11). Featuring both musical and theatrical elements, the concert will bring to life the remarkable story of the children at London’s Beatrix Potter School, who discovered and began a tradition of paying tribute to the graves of 18 Newfoundland First World War soldiers.

The show will take place at 2:00 p.m., and as a special Come Home 2022 event, admission is free for all ages. Event organizers are accepting donations at the door for the Poppy Campaign, which supports veterans and their families.

‘The 18’ will feature an original script written by composer and founder/co-artistic director of Best Kind Productions, Kyle McDavid. The moving narrative will be highlighted by performances from The Ennis Sisters, Petrina Bromley, Mason Dicker and Annabelle Ramsay, the Lakecrest Chamber Choir, Lady Cove Women’s Choir, La Rose des Vents, Newman Sound Men’s Choir, the NL Deaf Choir, The Royal Newfoundland Regiment Band, Silvern Voices from Corner Brook and the Singing Legionnaires.

‘The 18’ will also premiere a brand new song created especially for this event, ‘Forever Far From Home’, by Maureen Ennis and Perry Chafe and arranged by Leslee Heys.

Provincial Government Proposes Amendments to Workplace Health, Safety and Compensation Act

Proposed amendments to the Workplace Health, Safety and Compensation Act received second reading in the House of Assembly today.

The proposed legislation will address housekeeping items, incorporate gender-neutral language, modernize terminology, reduce red tape and achieve internal and cross-legislative consistency.

If approved, the amended Act will come into force on September 1, 2023. This will allow WorkplaceNL ample time to make the necessary internal adjustments these amendments will require. None of the proposed changes will affect benefits to injured workers or increase costs to employers, nor do they modify current obligations, authority levels, or rights.

The need for amendments to the Act were identified in the 2013 Statutory Review, the 2019 Statutory Review and on-going analysis of the current Act by WorkplaceNL and the Workplace, Health, Safety and Compensation Review Division.

Wild Life Act Amendments Improve Access to Outdoor Experiences and Resources

Recent amendments to the Wild Life Act reflect the Provincial Government’s commitment to improving access to outdoor experiences and resources, while continuing to manage the province’s big game resources sustainably for the benefit of all Newfoundlanders and Labradorians. Amendments include streamlining the documentation process for big game hunters who donate meat to registered food banks, as well as providing ministerial authority to define the residency requirement criteria.

Based on the success of the recent pilot program allowing registered food banks to collect and distribute big game meat, amendments address issues related to possessing and distributing donated moose and caribou meat. This includes documentation required for licensed butchers, registered food banks, food bank clients, and hunters who donate moose and caribou meat to third parties.

Another amendment provides the Minister of Fisheries, Forestry and Agriculture with the authority to define the residency requirement criteria for members of the Royal Canadian Mounted Police and Canadian Armed Forces.

These amendments are part of a responsible management approach that maintains healthy wildlife populations while continuing to provide hunters throughout the province with meaningful harvesting opportunities.

Ministerial Statement – Provincial Government Recognizes the Completion of the Trail of the Caribou

The following statement was read in the House of Assembly today by the Honourable Andrew Furey, Premier of Newfoundland and Labrador:

Speaker, I rise today to recognize an event that honours the past, has great significance in the present and reminds us of the sacrifices that were made for our future.

As we look forward to Remembrance Day later this week, I invite all Newfoundlanders and Labradorians to reflect on the freedoms they enjoy and consider how they will honour the fallen and all those who have served to protect those freedoms.

This past September, more than a century after Lieutenant-Colonel Thomas Nangle set out to create an enduring memorial to the valour and sacrifice of the Royal Newfoundland Regiment, his vision to establish The Trail of the Caribou was completed.

With the dedication of the final monument at the Gallipoli Peninsula Historical National Park, six life-size bronze caribou monuments now stand as a permanent tribute to the bravery of the Newfoundlanders and Labradorians who fought for freedom, and those who made the ultimate sacrifice, in critical battles in Türkiye, France and Belgium.

Today, I am pleased to welcome to the gallery His Excellency Kerim Uras, the Turkish Ambassador to Canada, whose country welcomed us in September for this historic event.

It meant so much to stand on that sacred ground – where once they stood, experiencing the horrors of war – to honour the brave members of the Regiment in such a meaningful way.

Speaker, I extend my sincere thanks to Ambassador Uras and the Gallipoli Peninsula Historic Directorate for their generosity and support in commemorating this important chapter of our history.

I also thank the Royal Canadian Legion and Veterans Affairs Canada, for their commitment to preserving and presenting Newfoundland and Labrador’s proud military history, and for their unwavering support as we worked together to fulfill Padre Nangle’s vision.

And of course, to the Royal Newfoundland Regiment and the Royal Newfoundland Regiment Advisory Council – thank you for your tireless dedication to ensuring that this memorial would be constructed.

Through your efforts and perseverance, the stories of the Royal Newfoundland Regiment will be remembered for future generations around the world.

Public Advisory: Requests for Wind Monitoring Activities on Crown Lands

The Department of Fisheries, Forestry and Agriculture is processing requests from wind energy project proponents for temporary wind monitoring activities on Crown lands. This process is not part of the ongoing crown land nomination and bid process with the Department of Industry, Energy and Technology. This is also separate from the environmental assessment process through the Department of Environment and Climate Change.

Wind energy project proponents are permitted to apply for a temporary licence to place data collecting meteorological evaluation towers on Crown lands. To date, five companies have applied for meteorological evaluation towers, and the applications cover 19 potential tower sites in the eastern, western and Northern Peninsula regions. Thus far, eight sites have been approved, one has been rejected, and all others are under assessment.

These licences are temporary during the data collection phase; once data collection is complete, the licence terminates and the conditions include the need for the site to be returned in a condition acceptable to the Minister of Fisheries, Forestry and Agriculture.

Minister Davis Attending 2022 United Nations Climate Change Conference

The Honourable Bernard Davis, Minister of Environment and Climate Change, is part of the Canadian delegation attending the 27th Conference of the Parties of the United Nations Framework Convention on Climate Change (COP27) in Sharm El-Sheikh, Egypt.

COP27 signifies the importance for world leaders to implement and transform key climate related decisions into concrete actions. The conference will focus on raising ambition, building upon the previous Conference of the Parties, including the COP26 outcomes (Glasgow Pact) with an aim to address the climate emergency and promote coordinated action to tackle climate change impacts and reduce emissions. COP27 is focused on four overall goals: mitigation, adaption, finance and collaboration.

Tomorrow (November 8), Minister Davis will be a panelist at an event hosted by the Ocean Frontier Institute at Canada’s COP27 pavilion. He will speak on the important role our oceans play in the carbon cycle, as well as opportunities to enhance the potential of our oceans as a carbon sink and a carbon capture and storage solution, as they can absorb more carbon from the atmosphere than they release.

The Provincial Government is committed to addressing climate change. Our actions include the implementation of a climate change action plan, a new renewable energy action plan, achieving net-zero greenhouse gas emissions by 2050, establishing a Net-Zero Advisory Committee and advancing electrification and innovation to further the transition into more renewable energy sources.

Virtual Engagement Sessions on Land Areas of Interest for Wind Energy Projects Launching Next Week

The Department of Industry, Energy and Technology is currently reviewing the recently submitted Nominations of Areas of Interest for wind energy projects in the Province. Next week, the department will host a series of virtual sessions with respect to those land areas of interest being considered for a future call for competitive land bids, starting in December 2022.

This input will be used to inform decisions about lands that may be made available for a competitive bid process for onshore wind development projects, and to help ensure the development of the province’s wind resources is undertaken in a responsible, timely, sustainable and competitive manner.

It is important to note that this engagement activity is incremental to further engagement that will be required as part of existing processes such as Environmental Assessment review, should development be proposed in a particular area.

The department invites stakeholder groups to the following virtual engagement sessions regarding two Land Areas of Interest for Wind Energy Projects:

  • Monday, November 14, 2022 from 12:00 p.m. – 1:30 p.m.
  • Tuesday, November 15, 2022 from 12:00 p.m. -1:30 p.m.

The intent of this engagement process is for the Provincial Government to:

  • Meet with representatives from the selected areas to provide an overview of the Crown land nomination process;
  • Inform the community that the area, selected through the recent call for Crown land nominations for onshore wind energy projects, may be offered as part of a competitive bid process; and
  • To determine the level of support for further consideration.

It is requested that participants pre-register. Those wishing to register for any of the sessions can email windlandnominations@gov.nl.ca.

An online questionnaire soliciting feedback will be made available at the link below immediately following the first information session. For more information on these public engagement sessions, visit www.engageNL.ca.

The department received 31 land nomination submissions for wind energy projects. Through a detailed assessment, the Provincial Government will determine which land package(s) will be made available for this first round of the competitive land bid process. The process is expected to be launched on December 15, 2022. More information on the competitive land bid process will be available in the coming weeks.

The Information and Privacy Commissioner, Michael Harvey, has released his Report A-2022-026 under authority of the Access to Information and Protection of Privacy Act, 2015. A summary of the Report is included below.

Report: A-2022-026 Report Date: November 3, 2022 Public Body: Office of the Child and Youth Advocate Summary: The Complainant made an access to information request under the Access to Information and Protection of Privacy Act, 2015 to the Office of the Child and Youth Advocate for records relating to the Complainant and their minor children. The Office of the Child and Youth Advocate responded by withholding all responsive records under section 41 of the Act. The Complainant made a complaint to this Office arguing jurisdiction, procedural fairness and the public interest. The Commissioner found that the Office of the Child and Youth Advocate’s application of section 41 was appropriate and recommended the public body continue to withhold the records.

The Honourable Bernard Davis, Minister of Environment and Climate Change, has announced the following relative to Part 10 Environmental Assessment of the Environmental Protection Act.

CONDITION of release Approved:

Southern Bay Blue Spruce R.V. Park and Campground                            (Reg. 2135)
Proponent: Camkap Software Development Group Inc.

On October 28, 2022, the Minister of Environment and Climate Change approved the Environmental Site Assessment (ESA) for the Southern Bay Blue Spruce R.V. Park and Campground. Completion of the ESA is a condition of release from environmental assessment for this project.

Undertakings Released:
Maccles Lake Road Farm Expansion                                                               (Reg. 2217)
Proponent:

The Project is released subject to the following conditions:

  • The proponent is required to uphold all commitments made in the environmental assessment submission to mitigate the effects of the Project on the environment.
  • The Department of Fisheries, Forestry and Agriculture requires the following conditions:
    • The proponent is to maintain a minimum 50-metre undisturbed riparian buffer from the high water mark of all wetlands and waterbodies within and adjacent to the Project that are identified on either the 1:50,000 scale National Topographic System maps, or the topographic mapping layer shown in the Provincial Land Use Atlas, to protect sensitive riparian and aquatic species and their habitats.
    • No vegetation clearing is to occur within 800 metres of a bald eagle or osprey nest during the nesting season (March 15 to July 31) and 200 metres during the remainder of the year. The 200-metre buffer also applies to all other raptor nests (e.g. Northern Goshawk, Sharp-shinned Hawk, Merlin, American Kestrel, Great-horned Owl, Boreal Owl, Northern Saw-whet Owl). The location of any raptor nest sites must be reported to the Wildlife Division. For more information, please contact the Wildlife Division at (709) 637-2052.
  • The proponent is required to advise the Environmental Assessment Division when the conditions of release have been met, by emailing a written description, documents, and images (where applicable) demonstrating that the conditions have been fulfilled.
  • The proponent is required to update the Environmental Assessment Division on the status of the Project, including a copy of all permits, licences, certificates, approvals and other authorizations required for the project, one year from the date of the release letter and to provide additional updates if requested.

Springdale Glove Manufacturing Facility                                                       (Reg. 2218)
Proponent: Superior Glove Works Limited

The Project is released subject to the following conditions:

  • The proponent is required to uphold all commitments made in the environmental assessment submission to mitigate the effects of the Project on the environment.
  • The Pollution Prevention Division of the Department of Environment and Climate Change requires the proponent to submit a Waste Management Plan for approval, prior to Project commencement. The Water Resources Management Division of the Department of Environment and Climate Change requires the following:
    • A Water Resources Management Plan that demonstrates the safe disposal of the facility’s process water and storm water runoff or the near by waterbody, without causing a significant adverse environmental effect.
  • The Department of Fisheries, Forestry and Agriculture requires the following;
    • No vegetation clearing is to occur within 800 metres of a bald eagle or osprey nest during the nesting season (March 15 to July 31) and 200 metres during the remainder of the year. Project Commemorates the 200th Anniversary of the Death of Demasduit

The Honourable Lisa Dempster, Minister Responsible for Indigenous Affairs and Reconciliation, today announced a contribution of over $115,000 to the Town of Botwood and the Botwood Mural Arts Society towards a commemoration project for the 200th Anniversary of the Death of Demasduit.

This commemoration project will involve the installation of a slightly larger than life bronze statue of Demasduit, Nonosabasut and their newborn child. The statue will be located on Botwood’s Blueberry Hill, overlooking the waterways on which the Beothuk travelled from their winter homes to their summer fishing grounds and upon which Demasduit’s life ended.

The statue will be surrounded by a healing garden, a place of quiet reflection for our shared journey towards Truth and Reconciliation. Demasduit died onboard the HMS Grasshopper in Botwood Harbour on January 8, 1820. The commemoration project to mark the 200th anniversary was delayed due to the COVID-19 pandemic.

This provincial contribution is in addition to $356,000 the town has received through the Legacy Fund of the federal Building Communities Through Arts and Heritage Program of the Department of Canadian Heritage, also announced today.

In addition to the Governments of Canada and Newfoundland and Labrador, other funding partners include the Town of Botwood, Miawpukek First Nation, Botwood Heritage Society, Botwood Mural Arts Society and the United Church of Canada.

This project is supported by all five Indigenous Governments and Organizations in Newfoundland and Labrador, and by all neighbouring towns in the Exploits region.

Public Advisory: Guy Fawkes Night Bonfires Should be Safe and Legal

Tomorrow (Saturday, November 5) is Guy Fawkes Night, and the Provincial Government is reminding residents to ensure bonfires are conducted in a safe and legal manner.

Residents are encouraged to attend a community-sponsored event, but for those who choose to hold a private bonfire, please ensure you are complying with municipal and provincial laws and contact your municipality, local service district, Inuit Community Government or local fire department for more information.

Residents are advised that it is against the law to openly burn plastics, tires, asphalt products, paint products, used oil, household garbage and treated wood. In areas where bonfires are permissible, residents are cautioned to take the following steps:

  • Fires should be placed on a gravel base eight to 10 metres from trees or structures;
  • Flammable liquids should not be used to start or accelerate a fire, and aerosol cans and pressurized gas cylinders, such as propane cylinders, should not be added to a fire;
  • Only adults should add material to the fire, and children should be kept at a safe distance at all times and closely supervised by guardians around a bonfire;
  • Property owners in the area of the fire should ensure all combustible materials are properly secured;
  • Bonfire organizers should ensure ready access to fire extinguishing tools and supplies; and
  • Once finished, the fire should be fully extinguished using water and/or gravel and the bonfire area should be cleared and returned to its previous condition.

Come From Away to Come Home to Gander in Summer 2023

Come From Away is coming home! Today, the Honourable Andrew Furey, Premier of Newfoundland and Labrador, announced that a home-grown, reimagined version of the internationally acclaimed theatrical production, Come From Away, will be housed in Gander, beginning in the summer of 2023.

With book, music, and lyrics by Irene Sankoff and David Hein, the Gander production will be executive produced by Come From Away’s originating producer, Michael Rubinoff.

Nationally renowned director and Newfoundlander and Labradorian Jillian Keiley is returning to the province from the National Arts Centre in Ottawa to direct Gander’s Come From Away.

Shows will take place at the Gander Arts and Culture Centre (Joseph R Smallwood Centre), under the leadership of Arts and Culture Centre director, Aiden Flynn. Performances will take place on Thursdays, Fridays, Saturdays and Sundays, beginning on July 7 with an official opening taking place on July 22.

The final performance of the inaugural run will take place on September 3, 2023.

Tickets go on sale on Monday, November 7 at noon via the Arts and Culture Centre website.
