Today, Mr. Travis Wooley, Chief Electoral Officer (Acting) of Newfoundland and Labrador, issued an election writ to the Returning Officer for the District of Conception Bay East-Bell Island. The by-election will take place on Monday, January 29, 2024.
The following key dates apply to this election:
- Election Day – Monday, January 29. Polls will be open from 8:00 am until 8:00 pm.
- Advance Poll – Monday, January 22. Polls will be open from 8:00 am until 8:00 pm.
- Deadline for Candidate Nominations – Sunday, January 7 at 2:00 p.m.
All times listed above are half an hour earlier in most of Labrador.

Minister Hogan Announces King’s Counsel Appointments
The Honourable John Hogan KC, Minister of Justice and Public Safety and Attorney General, is pleased to announce the province’s newest appointments to the King’s Counsel.
The honourary title of King’s Counsel recognizes senior lawyers for exceptional merit and contribution to the legal profession. These lawyers have served a minimum of 10 years as a member of the bar, have gained the respect of the legal community and are in good standing with the Law Society of Newfoundland and Labrador.
Appointments are made after consultation with the Legal Appointments Board as outlined in the Queen’s Counsel Act.
Those appointed to King’s Counsel are: Philip J. Buckingham, Anna Cook, Amy M. Crosbie, John Duggan, Ann Florence Martin, Kathleen M. O’Neill, Nicholas Whalen and Rodney Zdebiak. Biographies of each appointee can be found in the backgrounder below.

BACKGROUNDER
Biographies for King’s Counsel Appointees
Philip J. Buckingham
Philip J. Buckingham is a graduate of Memorial University of Newfoundland (B.A., 1986) and the University Of Saskatchewan College of Law (LL.B., 1989). He was called to the Bar of Newfoundland and Labrador and enrolled as a Solicitor of the Supreme Court in 1990.
He was an adjudicator on the Mental Health Review Board, a former Canadian Representative on the International Rugby Board Judicial Panel, and currently sits as a member of The Law Society’s disciplinary panel. He has contributed to Carswell’s Annual Civil Litigation Review, spoken at various conferences on matters of insurance, and for many years was an instructor in Civil Procedure at the Law Society’s Bar Admissions Course. He is recognized by Lexpert and Benchmark Litigation as a leading practitioner in the areas of insurance and commercial litigation.
He appears regularly before the Superior Courts of Newfoundland and Labrador, the Federal Courts of Canada and has appeared before the Supreme Court of Canada.
Anna Cook
Anna is a partner in the St. John’s office of Cox & Palmer. She was admitted to the Newfoundland and Labrador bar in 2000, after earning an undergraduate degree from Memorial University of Newfoundland (B.A. (English, French) 1995) and her law degree from Dalhousie University (LL.B. 1999).
Anna has an extensive and dynamic corporate and commercial practice, advising a broad and diverse group of clients ranging from small business startups to large multinational and international corporations. Anna handles commercial financings, commercial real estate, share sales, asset sales, mergers and acquisitions. As an offshoot of this, Anna has developed specialized expertise in the business matters relating to the fishing industry in this province, representing fishers, processors and lenders as they deal with enterprise sales, financing and regulatory matters.
Anna’s corporate and commercial clients also benefit from her experience in privacy law compliance and access to information requests, both on the federal and provincial level. Anna’s clients appreciate not only her sound and practical advice and counsel, but also her solution-focused approach, her timeliness and responsiveness.
Amy M. Crosbie
Amy M. Crosbie is a partner with Curtis Dawe Lawyers with over 27 years of litigation experience in range of practice areas. She completed a B.Sc.(Biology) from Memorial University of Newfoundland and Labrador in 1992 and a LL.B from the University of New Brunswick in 1995.
Ms. Crosbie’s litigation practice includes construction law, natural resource and energy law, family law and media law. She has, over the past 27 years, appeared before all levels of court in the province of Newfoundland and Labrador, as well as the Federal Court of Canada and numerous regulatory and administrative bodies, including commissions of inquiry.
Ms. Crosbie was peer-selected for inclusion in 2022 and 2023 editions of The Best Lawyers in Canada for her work in energy regulatory law, defamation and media law and family law. She is a member of the ADR Institute of Canada (ADRIC), the Canadian Energy Law Foundation and the Canadian Media Lawyers Association on which she previously served as the Atlantic Canadian representative. She served two four year terms as a Bencher of the Law Society of Newfoundland and Labrador. She is a past Chair of Newfoundland and Labrador Crime Stoppers and was appointed an Honourary Life Member of the Royal St. John’s Regatta Committee after serving for over 10 years as a committee and executive member.
Amy lives in St. John’s with her husband Gary Squires and their teenage children, Kate and Andrew.
John Duggan
John attended Dalhousie Law School in 1988 graduating in 1991. He articled with the late Barry Heywood then with the late Judge Gloria Harding at the Newfoundland and Labrador Legal Aid Commission. Upon his call to the bar on April 8, 1992, John remained with the Legal Aid Commission as a staff solicitor then went on to become the first Area Director for the St. John’s office for approximately four years then as Deputy Director – Legal until his retirement in June 2013.
John continued with his legal career as a sole practitioner with concentrations on criminal, family, and civil litigation. John also acts as a crown agent and as amicus curie when requested to do so.
Since the early days of his legal career, he had a keen interest in therapeutic justice, believing that treating the person was the best approach to ensuring a reduction in repeat offenses. John prepared the first funding submission for the creation of the present mental health court then continued with this work until the court was operational. John was then appointed by the Legal Aid Commission to the steering committee for the creation of the family violence intervention court and remained there until this court was operational.
John was also appointed to function as co-chair for the Ministerial Advisory Committee for the creation of a Drug Treatment Court in Newfoundland and Labrador. John continued this work on a volunteer basis for over two years until this court also became operational.
John has been married to his wife Debbie for over forty-six years where they reside in St. John’s and Charleston, Bonavista Bay.
Ann Florence Martin
Ann Florence Martin was born in St. John’s and attended school in Ferryland, St. John’s and Carbonear. She holds a Bachelor of Arts, Hons (1986) from Memorial University, receiving the gold medal for French Language Arts. After teaching in France for a year, she attended McGill University, graduating with a Bachelor of Laws in 1990. She articled at Martin Whalen Hennebury Stamp and practiced law there after being called to the Bar of Newfoundland and Labrador in 1991.
Ms. Martin first joined WorkplaceNL, the provincial workers’ compensation board, as Legal Counsel in 1995 and in 2006 was appointed General Counsel and Corporate Secretary. In 2023, she was appointed Chief Executive Officer for WorkplaceNL.
Ms. Martin’s career has focused on delivering legal, policy and other corporate services within Newfoundland and Labrador’s workers’ compensation system, participating as a member of the senior management team and providing legal and governance advice to the Board of Directors, as well as representing WorkplaceNL before the Supreme Court, the Court of Appeal and administrative tribunals.
Ms. Martin was elected as a Bencher of the Law Society of Newfoundland and Labrador in 2013 and served on the insurance committee, the complaints authorization committee, the executive committee and as president from 2020-2021. Ms. Martin is an Honorary Bencher and continues to serve as a member of the code of professional conduct review committee and the fitness to practice committee.
Ms. Martin is married to John J. Harris K.C. and mother to Amelia, Sarah and John.
Kathleen (Kate) M. O’Neill
Kate O’Neill was born and raised in St. John’s. She commenced her university studies at Memorial University of Newfoundland and Labrador and concluded her studies in French, with a minor in English Literature, at L’Université Laval with a Bachelière ès Arts. She went on to receive a Bachelor of Arts (Honours) in Communications at University of Ottawa and a Bachelor of Laws at Dalhousie University in Halifax, Nova Scotia.
Kate began her legal career with O’Reilly, Noseworthy as a summer student in 1998 and has continued to work with that firm and its successors, now Cox & Palmer, since her call to the Bar in 2001. She was called to the Nova Scotia Bar and practised in Halifax for a short period before returning to her home in St. John’s. Over that time, Kate’s practice has focused on civil, insurance, and commercial litigation, as well as employment and labour law, including formal training as a workplace investigator. She represents her clients before all levels of court in the province, as well as in arbitrations, professional disciplinary matters, and at the labour board and Human Rights Commission.
Kate has been a partner with Cox & Palmer since 2008, having served on the management committee of the firm, and acting as a member of the recruitment and diversity and inclusion Committees. She is a director of the Canadian Association of Counsel to Employers. Additionally, she is a member of the Canadian Bar Association and Canadian Defence Lawyers, and has been recognized in the Best Lawyers in Canada and Canadian Legal Lexpert Directory for her work in personal injury law, commercial litigation, and employment and labour. She is a senior member of the Cox & Palmer insurance group, which was recognized in 2022 as law firm of the year for insurance law by The Best Lawyers™ in Canada.
Kate is proud of and inspired by her long-time work as a member of the board of directors of Special Olympics Newfoundland and Labrador. She is kept happily busy on adventures with her husband, Robert Evans, and her family, Maggie, Siân, Lucy, Jake and grandson, Sullivan.
Nicholas Whalen
Nick Whalen was born and raised in St. John’s, graduating from Bishops College in 1991 as class valedictorian. He first studied and trained to be an engineer at Queen’s University, B.Sc.(eng) ’96, M.Sc.(eng) ’98, earning the D.S. Elliott Memorial Award for contribution by an engineering student to Queen’s University in athletics, academics and extra-curricular activities. While studying engineering, Nick spent three summers in Gratkorn, Austria with Philips Semiconductors, before deciding to pursue a career in patent law.
Nick’s legal education at McGill University, was supported by a Newfoundland and Labrador Law Foundation Scholarship and a McGill Law School National Programme Entrance Scholarship. While at law school, Nick was awarded the Patricia Allen Award for outstanding contribution to the faculty.
Being unable to train as a patent agent in Newfoundland at the time, Nick undertook articles with Deeth Williams Wall LLP, in Toronto, where he specialized in intellectual property and technology law, and was first called to the Ontario bar in 2002. He was then called to the New York State bar in 2005 and qualified as a patent agent in 2007. From 2007 until 2009, he worked Stikeman Elliott in Toronto, where he practiced primarily in mergers and acquisitions for technology companies.
Nick and his wife, Dr. Sarah Noble, finally moved home in 2009 to raise their children, Sophie and Isaac. Nick was called to the bar in Newfoundland and Labrador in May 2009, and practiced law with the firm McInnes Cooper, being named a partner in July 2011.
From November 2015 until October 2019, Nick was the Member of Parliament for the Riding of St. John’s East. In addition to duties in the House of Commons and in his riding, Nick served as chair of the Atlantic Liberal Caucus, chair of the House of Commons standing committee on citizenship and immigration and as a member of the House of Commons standing committees on natural resources and government operations and estimates.
After politics, Nick joined Benson Buffett PLC Inc. as counsel in the practice of law, and Deeth Williams Wall LLP for the prosecution of patent and trademarks as a registered agent.
Since 2012, Nick has been recognized by his peers for inclusion in Best Lawyers in Canada for intellectual property, information technology and technology Law.
Rodney Zdebiak
Born and raised in Winnipeg, Rod completed a Bachelor of Arts (with distinction) at the University of Manitoba in 1987, and went on to receive a Bachelor of Laws from Dalhousie University in 1992. While attending Dalhousie, he served as a student member of the Nova Scotia Branch of the Canadian Bar Association (1989-1992). After graduation, Rod and his spouse Wendy, moved to St. John’s, where Rod began articles at the St. John’s office of Stewart McKelvey. He was called to the Newfoundland and Labrador Bar in 1993 and became a partner at Stewart McKelvey in January 2000.
Rod practices primarily in the areas of insurance litigation and education law. Other areas of practice include real estate and municipal law.
In the 1990’s, Rod was a member of the Canadian Bar Association Young Lawyers’ Conference, and went on to become the Newfoundland and Labrador chair. Rod continues to be a member of the Canadian Bar Association, and in 2022, he was the recipient of the Honourable Robert Wells, QC Award, which recognizes outstanding public service and commitment to community and charitable causes.
From 2005 to 2018, Rod was a member of the Canadian Association for the Practical Study of Law and Education (CAPSLE), a nation-wide resource for those in the field of education law. In addition to attending annual meetings, Rod twice presented to CAPSLE on the topics of school closures and school re-organizations.
Rod was appointed as a bencher of the Law Society of Newfoundland and Labrador in 2017 to fill a vacancy and has since been twice re-elected. As a bencher, Rod has served on the discipline committee and acted as chair of the insurance committee. Rod currently serves on the code of professional conduct review committee and is the chair of the complaints authorization committee.
In 2015 Rod was appointed to the board of commissioners for Legal Aid NL. He currently sits on the board of commissioners human resources sub-committee and is the chair of the appeal board. Since 2018 Rod has taught a portion of the civil procedure section of the bar admissions course. In 2023, Rod was appointed to the Newfoundland and Labrador Human Rights Commission
Throughout his career, Rod has also volunteered his time and expertise to charitable organizations outside the legal community. In the 1990s, he was a member of the board of directors of Junior Achievement of Newfoundland and Labrador, an organization dedicated to educating students about work readiness. He also served on the board of directors of the Newfoundland Society for the Physically Disabled (now known as Easter Seals Newfoundland and Labrador) until 2010, and from 2006 – 2007 was vice-president. In addition to governance issues, he was involved in re-drafting the by-laws of the organization. Since 2003, he has served on the board of directors for Computers for Schools NL, an organization that provides students, non-profit organizations and families with computers and related technologies. He is also co-chair of the board of directors for Sound Arts Initiatives, which produces musical festivals, symphonies and concerts that celebrate music and sound in St. John’s and an organization for which he as volunteered in various capacities for over 30 years.

Provincial Government Announces First Accessibility Plan
The Honourable Paul Pike, Minister Responsible for the Status of Persons with Disabilities, today announced the first Government of Newfoundland and Labrador Accessibility Plan for January 1, 2024, to December 31, 2026.
The Accessibility Act requires all public entities, including the Provincial Government; agencies, boards and commissions; provincial courts; public and private educational institutions; Newfoundland and Labrador Health Services; and municipalities, to prepare and make accessibility plans public by December 31, 2023.
Accessibility plans are intended to help address the prevention, identification and removal of barriers in policies, programs and practices of public entities in collaboration with the community of and for persons with disabilities.
The Government of Newfoundland and Labrador’s Accessibility Plan aims to promote and foster equity in order to build a more accessible and inclusive province. This plan was informed by contributions of key stakeholders including persons with disabilities, representatives from the Network of Disability Organizations, and all Provincial Government departments.

Public Advisory: Squid Cove Resource Road Bridge Closed Until Further Notice
Effective immediately, a bridge located at the 2.7 kilometre mark on the Squid Cove Resource Road is closed to all vehicle, ATV, snowmobile and pedestrian traffic until further notice.
Forestry officials have identified structural damage to the bridge making it unsafe for public use. Warning signage is posted and the bridge is marked with yellow caution ribbon.
Squid Cove Resource Road is located approximately 3.5 kilometres south of the community of Castors River.

The Proponent is proposing to decommission and remediate the former small arms rifle range site located off route 480 in Burgeo. Project activities include soil excavation and sediment dredging and disposal, on-site impacted surface water treatment, and removal of debris. Public Advisory: Rushy Pond Brook Bridge Temporary Closure and Detour
The Department of Transportation and Infrastructure wishes to advise that Rushy Pond Brook Bridge on Route 1 (Trans Canada Highway) west of Grand Falls-Windsor is temporarily closed due to rising water levels today (December 22).
Traffic will be diverted to the newly constructed bridge which is adjacent to this structure and is in the final stages of construction. The contractor is on site and preparing the new bridge for opening which is anticipated to be within the hour. Motorists are asked to avoid this area until the bridge is opened.

Report: AH-2023-001 Report Date: December 21, 2023 Public Body: Newfoundland and Labrador Health Services Summary: The Complainant requested from Newfoundland and Labrador Health Services (NLHS) a report made under the Adult Protection Act in relation to their spouse. NLHS denied access to the record relying on section 29 of the Adult Protection Act. The Complainant made a complaint to our Office stating that, as the substitute decision- maker for their spouse, they believed they were entitled to the entire record. The Commissioner found that NLHS’s denial of the complete record is not compliant with the requirements of the Personal Health Information Act and recommended that NLHS complete a line-by-line review of the report and release information where appropriate.-30-

Supporting Research and Development in Health Tech
To support research and development, the Honourable Andrew Parsons, KC, Minister of Industry, Energy and Technology, today announced $553,693 in funding for SiftMed under the Business Growth Program.
SiftMed’s platform uses machine learning and artificial intelligence to sort medical-related documents. The company is working to expand its technology to a predictive analytics model in order to:
- Help users quickly assess claim health issues;
- Create a more efficient risk assessment process; and,
- Accurately predict medical claim complexities, identify potential health concerns within a claim that could identify and triage a claim as complex.
As part of this funding, SiftMed will undertake a 13-month research and development project to enhance the company’s existing product and provide better understanding of medical claim complexities and trends. Funding from the Provincial Government will support six new technical positions.

Update on Initiatives Improving Access to Health Care in Newfoundland and Labrador
The Provincial Government is providing updates on innovative solutions that are increasing access to health care in Newfoundland and Labrador and resulting in patients receiving health care sooner than anticipated.
To date:
- 104 patients have been transported on 14 chartered flights from Labrador and Western Newfoundland for cardiac catheterization procedures in St. John’s;
- 163 surgeries have been completed by the orthopedic team travelling from St John’s to St. Anthony to Carbonear; and
- 216 same-day/outpatient hip and knee replacement surgeries have been completed at St. Clare’s Mercy Hospital.
As a result of the success of the same-day fly-in/fly-out cardiac catheterization flights, known as Heart Force One, over the past year, NL Health Services has issued a request for proposals (RFP) for regular flights. The RFP is scheduled to close on January 11, 2024.
The orthopedic surgery program has recently expanded to Western Newfoundland, which will also increase the number of same-day/outpatient joint replacement surgeries as well as additional inpatient surgeries.
In addition, a pilot project has been established in Gander in which patients are admitted overnight following knee replacement surgery, and then transition to an outpatient ambulatory rehabilitation clinic for ongoing care and recovery. It has completed 32 knee replacement series to date, and Central Zone estimates this will lead to over 200 additional surgeries each year when fully implemented.
With these four initiatives, the health authority anticipates performing over 700 additional surgeries each year.
These innovative approaches to managing waitlists for orthopedic surgeries and cardiac catheterization procedures help to reduce the backlog and make wait times shorter and result in more available beds in hospitals, which provide quicker admissions for patients in need of further care and treatment.

Public Advisory: Residents Reminded of Available Mental Health and Addictions Resources
Residents of Newfoundland and Labrador are reminded that mental health services are available during the holiday season.
Some key mental health supports and services during the holiday season include:
- 811 – Provincial HealthLine: Telephone support for people who are experiencing mental health crisis. The 811 phone line is available 24/7 and staffed by registered nurses who are trained crisis interveners and provide health advice for mental health and addiction questions.
- 988 – Federal Suicide and Crisis Line: Support is available 24 hours a day, seven days a week.
- Mobile Crisis Response Teams: Community-based crisis intervention services provided by mental health clinicians and trained police officers, located in St. John’s, Gander, Grand Falls-Windsor, Corner Brook, Stephenville, Happy Valley-Goose Bay and Labrador City, available seven days a week. Call 811 HealthLine or 911 to request a mobile visit.
- Doorways Mental Health Walk-in Clinics: Rapid access to mental health and addictions counselling services, available in 69 locations throughout the province. Most locations offer same-day, walk-in, or phone service with no appointment or referral required. Call 811 to find a location near you.
- Lifewise Warm Line: A non-emergency, non-crisis telephone support and referral service provided by trained peer support workers. Available seven days a week, 10 a.m. to midnight. Call 1-855-753-2560.
- Bridge the gapp: An extensive suite of e-mental health and addictions services available by visiting Bridge the gapp. Also includes information on where and how to access longer-term individual and group mental health and addictions counselling in communities across the province.
- 211: provides quick access to information and referral to community, social, health and government services. The line is 100 per cent free and confidential, available 24 hours a day, seven days a week by phone or online.
- Crisis Text Line: A 24/7 text line that connects individuals with a trained, volunteer crisis responder by texting HOME to 741741. The service is free, confidential, and provided by Kids Help Phone.
- Recovery Centre: The Medical Withdrawal Management Centre is available to anyone 16 years of age and older who is intoxicated or experiencing withdrawal from alcohol or other drugs. People can self-refer by calling 709-752-4980 or toll-free at 1-877-752-4980.
- The Provincial Opioid Dependence Treatment (ODT) Line: A toll-free line to support individuals, family members and health providers who are seeking information and support regarding opiate use. Available from Monday to Friday, 8:30 a.m. to 4:30 p.m. individuals can call toll free at 1-844-752-3588.
- 911: 911 is also available province-wide in Newfoundland and Labrador. Call Takers located in the province are available 24/7 to connect callers to the local emergency response agencies in your area.

Provincial Government Now Accepting Applications from Interested Ride Sharing Operators
The Provincial Government is now accepting applications from operators interested in offering ride sharing services in the province. The application is available on Government’s website.
Ride sharing providers will be required to follow the same provincial rules and safety standards as taxi services in order to operate. To help meet demand for affordable, reliable and safe transportation services, a provincial approach to ride sharing services will also help ensure consistency in regulation and enforcement.
Regulations for ride sharing were published in the Newfoundland and Labrador Gazette today. Upon publication, both the Regulations and the amended Highway Traffic Act are in effect.

Public Advisory: Individual Facing Several Charges for Wild Life Act Violation
A recent investigation by officers with the Department of Fisheries, Forestry and Agriculture’s Resource Enforcement Division has resulted in charges against an individual for several violations of the Wild Life Act.
On October 30, 2023, resource enforcement officers from the Clarenville detachment initiated an investigation after receiving information regarding suspected illegal hunting activity in the area of Old Mill Road in Goobies.
As a result of the investigation, an individual was identified and charged with:
- Failure to affix or lock the tag on a big game animal;
- Discharging a firearm within 300 meters of a dwelling;
- Discharging a firearm on or across a public road; and
- Possession of a big game animal not taken in accordance with Regulations.
The accused is scheduled to appear in Provincial Court on January 18, 2024 to face the charges. Penalties associated with these offences include a fine up to $5,000, up to six months in prison and a prohibition from holding a moose or caribou licence for a period of five years.
The public is reminded it is an offence under the Wild Life Act to discharge a firearm without exercising reasonable care for the safety of others.
The Government of Newfoundland and Labrador is committed to protecting the province’s wildlife resources and ensuring they are sustainably managed for the enjoyment and benefit for all residents of the province.
The public are encouraged to report suspected illegal hunting activity, as this information plays a significant role in assisting investigations being conducted by resource enforcement officers.
The public can report suspicious activity anonymously by calling 1-800-820-0990 or Crime Stoppers at 1-800-222-TIPS. Anonymous reports can also be submitted online at www.nlcrimestoppers.com or www.stoppoaching.ca.

Public Advisory: Rocky Brook Road Bridge Closed Until Further Notice
The Rocky Brook Road Bridge, which is located on a forest access road approximately 13 kilometres north of the Town of Badger, was closed to all vehicle, ATV, snowmobile and pedestrian traffic on December 13, 2023, until further notice. Structural damage to the bridge has made it unsafe for use. Signage has been posted and barricades are being erected tomorrow (December 21, 2023) to prohibit public access and ensure public safety.
Access to the Paul’s Lake Cottage Development Area is still available through the Aspen Brook Resource Road at the 28.5-kilometre mark.

Provincial Government Issues a Request for Proposals for the Sale or Lease of Bull Arm Site
In an effort to explore potential options to maximize use of the Bull Arm Fabrication Site, the Honourable Andrew Parsons, KC, Minister of Industry, Energy and Technology, today announced the release of a Request for Proposals (RFP) for the possible sale or lease of the Bull Arm Fabrication Site.
The RFP process for the sale or lease of the Bull Arm Fabrication Site will ensure that all proposals are assessed in a fair and transparent manner. The main objective of the RFP is to ensure that the site continues to be used in a fashion that provides the maximum economic and employment benefit to the people of Newfoundland and Labrador, while also providing a viable long-term business opportunity for potential proponents.
After proposals are received and assessed, government will determine which, if any, of the plans that are forthcoming warrant proceeding to the next significant step of commercial negotiations. The RFP does not bind government to proceed with a sale or lease of the site to any of the respondents. The Provincial Government welcomes all potential proponents to submit proposals in compliance with the direction in the RFP, which can be found on the department’s website.
The Bull Arm Fabrication Site is Atlantic Canada’s largest fabrication site. It spans over 25 square kilometres with 10 kilometres of paved roadway, and 20,600 square metres of enclosed fabrication facilities and marine infrastructure. The site was originally developed for the Hibernia project in the 1990s but has played a key role in the development of a number of major projects since that time, including serving as the location for the construction and integration of major components for the Hebron project. The lease for the Bull Arm Site is currently held by Bull Arm Fabrication Inc., which operates the site on behalf of the Provincial Government.

Request for Qualifications Re-Issued for Her Majesty’s Penitentiary Replacement
The Provincial Government has re-issued a Request for Qualifications (RFQ) for the replacement of Her Majesty’s Penitentiary. As a result of significantly increased construction costs, the parameters of the project have been re-evaluated with an aim of procuring a new facility that is fiscally responsible, while maintaining the new planned programming.
The Honourable John G. Abbott, Minister of Transportation and Infrastructure, along with the Honourable John Hogan, Minister of Justice and Public Safety, will be available to the media today (Wednesday, December 20) outside of the House of Assembly, Confederation Building, at 10:30 a.m.
Since 2020, challenging market conditions, such as ongoing supply chain issues and inflation linked to factors such as COVID-19, have impacted construction of infrastructure projects. Some construction materials are reported to have increased by 200-300 per cent, with construction labour costs having increased 100 per cent over historical labour costs required to complete similar projects. However, the need for a new correctional facility remains, and the Provincial Government has made the necessary adjustments to the scope of the project in order for it to advance.
The RFQ represents the first stage in a two-stage procurement process for the 280-bed capacity correctional facility. Following the RFQ process, a Request for Proposals will be issued to design, build, finance and maintain the new facility.
In the interim, the Provincial Government will be implementing temporary enhancements until Her Majesty’s Penitentiary is replaced. For example, temporary outbuildings are being considered to increase space for accommodations, services and programming, which will help improve the experience of staff and inmates.
Information on the RFQ will be available the first week of January 2024 on www.merx.com/govnl. The deadline for receiving proposals is February 16, 2024, after which time qualified bid teams will be invited to respond to a Request for Proposals stating project requirements.

Public Advisory: Hunters Reminded to Submit Licence Returns and Harvested Big Game Jawbones
Big game hunters are reminded to complete and submit licence return forms and wildlife samples to the Department of Fisheries, Forestry and Agriculture’s Wildlife Division. Wildlife managers use the valuable information hunters and trappers submit to make science-based recommendations about wildlife management, including quotas and regulatory changes.
Hunter return forms help wildlife managers monitor the status of big game numbers and flag any changes in hunter trends or populations. Successful hunters, including those from last season who have not yet done so, are encouraged to submit their hunter return forms as soon as possible by email to wildlifelicense@gov.nl.ca, or online at the Wildlife Information Management System website. Returns may be submitted by mail to: Wildlife Division, P.O. Box 2006, Corner Brook, NL. A2H 0J1
Jawbones collected from harvested moose and caribou provide information on the health and status of populations, including age and growth patterns, condition, productivity, and recruitment. Participating big game hunters will receive a Cooperating Big Game Hunter Crest. Successful hunters can drop big game jawbones off at one of 50 locations across the province.
Successful bear hunters can return information using the tooth envelope and instructions included with their licenses. Participating black bear hunters will also receive a Cooperating Big Game Hunter Crest.
Wolf and coyote hunters and trappers throughout the province can submit carcasses to their nearest Forestry and Wildlife district office. The department will pay a $25-fee for canid carcasses. Hunters can also contact the Newfoundland and Labrador Outfitters Association at info@nloa.ca to apply for an additional $35 per carcass under the Canid Incentive Program.

Premier Furey Announces Support for Port of Argentia Marine Terminal Expansion
The Honourable Dr. Andrew Furey, Premier of Newfoundland and Labrador, today announced a more than $15 million investment to support the Port of Argentia’s Multi-Tenant Docking Infrastructure Project. The investment will support the region to capitalize on emerging opportunities in the offshore and renewable energy industries, and contribute to sustained economic activity.
The Port of Argentia will carry out a multi-year project to develop a multi-purpose, ice-free marine support and service base in the area of Cooper Cove in Argentia harbour.
The proposed development is divided into two components. The first component encompasses a marine base while the second component encompasses a roll on roll off ramp to service the energy industry and other innovative industrial clients.
The Provincial Government’s support for the project leverages considerable private and Federal Government investments in infrastructure. This investment of $15,180,000 will leverage the remaining project financing of more than $72 million from a combination of the applicant, industry and the Government of Canada’s National Trade Corridor Program.
The project is supported through the Innovation and Business Development Fund. The fund was established in September 2018 to grow and diversify Newfoundland and Labrador’s oil and gas supply and service capabilities. In response to the growing renewable energy sector, the program guidelines have been updated to highlight that the program includes renewable energy. The $60 million, multi-year program was a result of the benefits agreement related to the White Rose Extension.

Public Engagement Underway for Proposed Wild Life Act and Endangered Species Act Amendments
The Department of Fisheries, Forestry and Agriculture is seeking feedback on proposed amendments to enforcement-related provisions, fines and penalties in the Wild Life Act, Endangered Species Act and applicable regulations.
The proposed legislative amendments aim to:
- Increase fines and penalties to create a stronger deterrence of illegal activities.
- Clarify and enhance legislative provisions related to conservation officer responsibilities.
- Modernize legislation for clarity and ease of interpretation.

The Government of Newfoundland and Labrador, the Impact Assessment Agency of Canada and the Nunatsiavut Government are each required to conduct an environmental assessment of the above noted project. The three jurisdictions are working together to avoid duplication in the environmental assessment, and each jurisdiction will make a decision on the undertaking.
The Proponent proposes to construct a new airport to replace the existing airstrip in Nain, Labrador. The project would include an 1,830-metre-long gravel runway, a multifunctional airport terminal, hanger and other related infrastructure, and a 13-kilometre access road. The new facility would operate year-round to provide essential services to the community. The undertaking was registered on December 18, 2023; the deadline for public comments is February 16, 2024; and the minister’s decision is due by February 26, 2024.

Badger Chute Quarry (Reg. 2281)
Proponent: Penney Paving Limited
The Proponent is proposing to construct and operate a 10-hectare quarry approximately 5 km southeast of the town of Badger. Development would consist of clearing the site of organic material and mineral soil before proceeding to remove sand and gravel resource material. The purpose of the quarry is to supply aggregate products for construction contracts throughout central Newfoundland. Black Mountain North Quarry (Reg. 2282)
Proponent: Newcrete Investments Limited
The Proponent is proposing to develop a 116.6-hectare sand and gravel quarry in the Black Mountain Pond region within the City of St John’s municipal boundary. The quarry location is approximately 1-kilometre northwest of Incinerator Road, off the Foxtrap Access Road. Access to the site would include development of a new 480-metre access road and relocation of 2.2 kilometres of existing ATV trail that currently runs through the proposed quarry site. The quarry material would be used for aggregate and concrete production operations across the province. ENVIRONMENTAL IMPACT STATEMENT REQUIRED:
Strange Lake Rare Earth Mining Project (Reg. 2272)
Proponent: Torngat Metals Ltd.
The minister has advised the Proponent that an environmental impact statement (EIS) is required for the project. Additional information is needed to inform the minister of the following, including but not limited to: effects of the project on caribou and habitat; updated field surveys; quarrying and exploration activities; assessment of the effects of the lower-grade ore stockpile; permissions for carrying out project activities on private land; impacts of road construction on permafrost; baseline assessments of human health factors; consultation with Indigenous Governments and Organizations and the public; and measures that will be taken to mitigate for adverse effects.
An Environmental Assessment Committee will be appointed by the minister to prepare draft guidelines for conducting the EIS and to provide scientific, technical and regulatory advice. Project information is available at www.gov.nl.ca/ecc/projects/project-2272/ .
UNDERTAKINGS RELEASED:
Maccles Lake Road Beef Farm Expansion (Reg. 2274)
Proponent: Gordon’s Farm / Maccles Ridge Ranch
The project is released from environmental assessment subject to the following conditions:
- The Proponent must uphold all commitments made in the environmental assessment submission to mitigate the effects of the project on the environment.
- The Department of Fisheries, Forestry and Agriculture requires the following:

- A minimum 50-metre, undisturbed riparian buffer zone shall be established around all waterbodies, from the high-water mark, that are identified on either the 1:50,000 scale National Topographic System maps, or the topographic mapping layer shown in the Provincial Land Use Atlas, to protect sensitive riparian and aquatic species and their habitats; and
- Vegetation clearing is not to occur within 800 metres of a bald eagle or osprey nest during the nesting season (March 15 to July 31) or within 200 metres during the remainder of the year. The 200-metre buffer applies to all other raptor nests (e.g. Northern Goshawk, Sharp-shinned Hawk, Merlin, American Kestrel, Great-horned Owl, Boreal Owl, Northern Sawwhet Owl). The location of any raptor nest sites shall be reported to the Wildlife Division.
- The Proponent must advise the Environmental Assessment Division when the conditions of release have been met, by e-mailing a written description, document, and images (where applicable) to demonstrate that the conditions have been fulfilled.
- The Proponent must update the Environmental Assessment Division on the status of the project, including a copy of all permits, licenses, certificates, approvals and other authorizations required for the project within one year from the date of release, and to provide additional updates if required.

Proponent: Zeta Osmond
The Project is released from environmental assessment subject to the following conditions:
- The Proponent must uphold all commitments made in the environmental assessment submission to mitigate the effects of the project on the environment.
